Terms and Conditions & Disclaimer for BetterKit

1. Introduction

By downloading, installing, or using BetterKit (the "Software"), you confirm your acceptance of, and agree to be bound by, these Terms and Conditions (the "Agreement"). If you do not agree to these terms, do not use the Software.

2. Effective Date

This Agreement takes effect on the date you first purchase or use BetterKit.

3. License Grant

EA STEEL SIA (the "Licensor"), a company registered in Latvia, hereby grants you a perpetual, non-exclusive, non-transferable, worldwide license to use, modify, and distribute the Software in source or compiled form for your personal or commercial projects.

• No subscription or recurring fees apply.
• You may not sell, sublicense, or redistribute BetterKit itself as a standalone product or template without significant modifications.
• The Licensor reserves the right to terminate this license at any time, for any reason, without notice. Upon termination, you must cease all use and distribution of the Software.

4. Refund Policy

Due to the digital nature of the Software, all purchases are final. No refunds, credits, or exchanges will be issued once access to BetterKit has been granted.

5. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. LICENSOR EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EA STEEL SIA, ITS AFFILIATES, LICENSORS, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION), ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LICENSOR'S TOTAL AGGREGATE LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE.

7. Your Responsibilities

• You are solely responsible for reviewing, testing, and validating the Software before deploying it in any environment.
• You assume all risks associated with its use, including any damage to your codebase, systems, or data.
• You agree to comply with all applicable laws and regulations when using the Software.

8. Intellectual Property

All title, ownership rights, and intellectual property rights in the Software and any copies thereof remain with EA STEEL SIA. You shall not remove or obscure any proprietary notices from the Software.

9. Price Adjustments & Updates

EA STEEL SIA may, at its discretion, change the price of the Software or introduce new editions. Customers who have already purchased BetterKit at a given price will continue to receive updates for free.

However, EA STEEL SIA does not guarantee any updates or specific timeframes for updates. Any updates provided are at the sole discretion of EA STEEL SIA and should be considered a bonus, not an obligation. The product you are purchasing is in its current state at the time of purchase and the price paid is final with no implied promise of future enhancements or improvements.

10. Changes to This Agreement

EA STEEL SIA reserves the right to modify or update this Agreement at any time. Changes become effective upon posting to the official BetterKit website. Your continued use of the Software after any such changes constitutes your acceptance of the new terms.

11. Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Latvia, without regard to its conflict of law principles. You agree that any dispute arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Riga, Latvia.
